Everything You Need To Know About How I Deliver All Of My Brand Photography Services
The Money Bit
Booking Fee
There is a standard non-refundable booking fee of 50% of your service at the time of placing your booking. This sum secures the time and services of your photographer and is non-refundable or transferable in the event of a cancellation, it being agreed loss suffered by your photographer due to cancellation. Cancellation less than 48hours before the Photoshoot Session date will result in the payment being with-held in full. All cancellations must be in writing. Shoots that are postponed to a later date will retain the fee as long as your photographer can re-schedule for the proposed new date and time.
Payments
Payment of the remaining 50% of your service is due 48hrs before your photoshoot date. No finished images will be made available until full payment is received.
Prices
All prices are confirmed with you when signing your booking contract, but in the event that changes arise that are outside of your Photographer(s) control, for instance, but not exclusively, the cost of Prints, Optional Extras, Travel and Subsistence, then you will be informed of such within 21 days of the change taking effect.
Shoot Day
Images
All images sizes are nominal. Your Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials, especially man-made fibres. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye. The number and style of photographs delivered to you the client by your Photographer shall be deemed correct.
Creative Licence
Your Photographer shall be granted an artistic licence in relation to the poses photographed and the locations used. The style and number of photographs shot are also dependent on the vagaries of the weather and the availability and willingness of the client. Your Photographer will make the best effort to honour requested photographs but does not undertake any guarantee for any specific picture nor incorporate any specific background, location or group arrangement.
Marketing & Retouching
Display
Your Photographer may display any photographs produced as a result of this contract on the Business Website and Social Media Channels, as part of any Portfolio, Literature, Display Areas, Exhibitions, Competitions, Advertising, or Slideshows and for commercial gain as part of copyright law. Expressly denying this use is considered to be a gesture of goodwill on the part of the Photographer, and in order to do this, the clients need to provide this in writing.
Signing your service contract is also deemed as your agreement to Model Release for such use of Photography. Should you wish to enter into any form of a non-disclose agreement to prevent the display of your final images you need to request the terms of this new agreement be drawn up for you in addition to this agreement.
Retouching
Enhanced Retouching, digital manipulation and artist finishing is available to the Client as an optional extra, where this goes over the standard time allocated to the client as part of the service of this contract. Additional fees may be due to cover this work. Your photographer will provide the costs for this additional work on a client-by-client basis and will advise of this charge prior to any work being carried out.
Reorders
All reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given thru the given channels.
Copyright & Legal
Copyright
Any images or copies of images whether sorted digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright And Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the permission of The Photographer in writing.
Negatives/Digital Files remain the property of your Photographer. Please advise all suppliers involved in your business to contact me in the first instance to obtain copies of photographs for commercial gain. Breach of the licence issued will result in legal action.
Licenced Images
Images supplied by me on a USB/DVD as jpeg format digital files will be of sufficient resolution for printing up to size A4/A3/A2.
They are licensed to you for commercial gain within set reasonable boundaries.
Third-Party Printing
Laura Pearman Creative cannot accept responsibility or liability for colour balance or quality of any Prints reproduced from the digital files that we have supplied by Third Party Printers such as High Street Photo Processing Shops or even in certain publications.
Liability
Attendance
In the unlikely event that the assigned Photographer is unable to attend your Photoshoot Session due to any unforeseen circumstances, we reserve the right to cancel in extreme circumstances. Rest assured that this would only happen at the last minute in only an emergency situation.
Travel Expenses
For attendance at venues at a distance exceeding a 30mile radius from Tyne & Wear NE32 (UK), Travel Expenses may be incurred by the client. Depending on the extent of the travel and schedule of your Photographer and any applicable third party suppliers in the year and season, calculations on these expenses is made on a client-by-client basis.
This is discussed with you at the time of your booking, and you are made fully aware of how this affects your invoice.
Limitation Of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of this contract. Neither party shall be liable for the indirect or consequential losses.
Just In Case
Force Majeure (Act Of God)
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
Cancellation
The Client may cancel their contract of service at any time by giving written notice to Your Photographer(s), but in doing so shall forfeit any monies paid. Cancellation less than 2 weeks before the Photoshoot Service will result in 50% payment to remain due in full, or loss of deposit payment. Cancellation less than 1 week before the Photoshoot will result in the payment remaining due in full.
Complaints
Any complaints should first be raised by you the Client with your Photographer in writing within 21 days from the date of receipt of images.
Cooperation
The Client and your Photographer consent to happily cooperate and communicate with each other to achieve the best possible result within the understanding of this contract.
